Mr. Scheer has a thriving litigation practice and focuses on complex and commercial litigation. He is admitted in Federal and State Court, as well as the U.S. Supreme Court, and he has tried cases in admiralty, collapse coverage, construction, breach of contract, construction defect, property insurance/bad faith, civil forfeiture, subrogation, personal injury, wrongful death, criminal prosecution and professional and products liability. Mr. Scheer was both trial and appellate counsel in Cunningham vs. State, 61 Wn. App. 562 (1991), Schwindt vs. Lloyd's of London, 81 Wn. App. 293 (1996), and Seattle Pump Co., Inc., vs. Traders and General Ins. Co., 93 Wash.App. 743 (1999), all of which established new law in the state of Washington. Among other reported cases, Mr. Scheer was also both trial and appellate counsel in Weiland v. Gordon, 1999 WL 44453 (1999), Law v. Pagtaluna, 166 Or. App. 551 (2000), Hill v. Jawanda Transport, Ltd., 96 Wash. App. 537 (1999), Teja v. Brar, 106 Wash. App. 1013 (2001), and Boyer v. Robertson, 147 Wash.2d 1015 (2002), four of which involved wrongful death suits, and the fifth involving significant claims for personal injury instituted in the U.S. and dismissed to foreign jurisdictions based on forum non conveniens. The dismissals were affirmed on appeal. He was also trial and co-appellate counsel in Commonwealth Ins. Co. of Am. v. Grays Harbor County, 120 Wn. App. 232, 84 P.3d 304 (2004), a successful appellate decision from a declaratory judgment action involving first party coverage and building code upgrade coverage.
In addition to speaking at numerous regional, national and international conferences and seminars and giving presentations to various insurers, businesses, trade groups and professional associations on a variety of legal topics, Mr. Scheer has appeared on ABC’s Good Morning America, discussing a product liability case in which he was lead counsel. Mr. Scheer has received his “AV” rating from Martindale-Hubbell, which is the highest peer based rate indicating very high to preeminent legal abilities and highest ethical rating. Mr. Scheer has also been selected by Washington Law & Politics magazine as one of their Super Lawyers for 2007.
Mr. Scheer is a member of the International Association of Defense Counsel, the Loss Executive Association, the Defense Research Institute and the Maritime Lawyers Association. Mr. Scheer is also a member of the Washington Defense Trial Lawyers (“WDTL”), and he currently serves as a Trustee on the Board of Directors for WDTL, where he also serves as the Chair of the Construction Committee, and immediate past Chair of the Judicial Liaison Committee. In addition to his admission to the Washington Bar in 1987, Mr. Scheer is also admitted to practice in the states of Oregon, Idaho and Alaska. He has handled and managed cases in multiple jurisdictions, and he has tried cases and argued appeals in Oregon, Washington and Alaska. Mr. Scheer received his J.D. from the University of Oregon Law School in 1986 and his B.S. in Rhetoric and Communication from the University of Oregon in 1982.
